ACCUSED SENTENCED IN A CHEATING CASE RELATING TO CIVIL SERVICES EXAMINATION-1996

The Special Magistrate for CBI Cases, Indore has convicted Shri M Balakrishana Reddy U/s 417, 468 r/w 471 r/w 511 IPC and sentenced him to undergo two years Rigorous Imprisonment in a cheating case relating to Civil Services Examination 1996.

A case was registered on 20.01.1997 on a complaint of the then Joint Secretary, UPSC, New Delhi on the allegation that some pre-written forged supplementary answer books, which were not supplied by the UPSC to its examination centre for the Civil Services (Main) Examination 1996, held at Govt. Hamidia Arts and Commerce College, Bhopal had been recovered from the possession of Shri M Balakrishana Reddy during the examination.

During the investigation of the case, it was revealed that Shri M Balakrishana Reddy having qualified in the preliminary examination, had appeared in the Civil Services (Main) Examination 1996 in the examination centre at Hamidia Arts and Commerce College, Bhopal on 1.11.1996 with Roll No.54248. At about 1100 hrs.Shri M Balakrishana Reddy asked for supplementary answer books and the Invigilator supplied him one supplementary answer book after obtaining his signature. At this juncture, the Invigilator saw some copies hidden inside the shirt of the accused and asked him to take out the hidden copies. On this, he took out the pre-written supplementary answer books which were very similar to the answer books of UPSC. Out of these four recovered copies, three copies were having rubber stamps as “CIVIL SERVICES (MAINS) EXAMINATION”. It was found that the accused had written only ten pages of his main answer book supplied by the above examination centre. On being asked, the accused gave a confessional statement under his signature. Investigation further revealed that the pre-written four supplementary answer books recovered from the accused at Examination Centre were forged and the rubber stamp which was affixed on the forged supplementary answer books got prepared by the accused from the Rajhans Rubber Stamp, Sultania Road, Bhopal.

After thorough investigation, a charge sheet was filed in the Court of Special Magistrate for CBI Cases, Indore on 24.10.1997 against Shri M Balakrishana Reddy u/s 420 r/w 511 IPC and 468 and 471 IPC. On 23.12.2002 the charges were framed against the accused u/s 417 IPC r/w 511, 468 and 471 IPC instead of u/s 420 r/w 511 IPC and 468 and 471 IPC.

The Trial Court found the accused guilty and convicted him.
