CBI FILES A CHARGESHEET AGAINST THEN DG(FAMILY WELFARE) AND THREE OTHERS IN CONNECTION WITH ALLEGED IRREGULARITIES IN THE IMPLEMENTATION OF NATIONAL RURAL HEALTH MISSION(NRHM) FUNDS IN UTTAR PRADESH

            The Central Bureau of Investigation has today filed a chargesheet against the then DG, Family Welfare; Director of Moradabad-based private firm & a close associate of the then Minister of Family Welfare(UP); Director of Gajraula-based private firm and Gajraula-based private firm through its Director U/s 120-B r/w 420, 467, 468, 471 IPC and Sec. 13(2) r/w 13(1) (d) of P.C. Act 1988 in the court of Special Judge, CBI, Ghaziabad. The Director of Gajraula(UP)-based private firm was arrested today and produced in the court alongwith the chargesheet.

 

            The Central Bureau of Investigation had earlier registered five Preliminary Enquiries relating to alleged irregularities in the execution and implementation of National Rural Health Mission(NRHM) funds in the State and UP since its inception in the year 2005-06 till November, 2011 on the directions of the Hon’ble Allahabad High Court, Lucknow Bench passed vide order 15.11.2011. On the basis of findings in one of the five PEs, one regular case was registered on 18.01.2012 U/s 120-B r/w 420, 465, 468, 471 of IPC and U/s 13(2) r/w 13(1)(d) of PC Act, 1988 against an IAS, the then Principal Secretary( Health & Family Welfare), Govt. of UP, Lucknow; the then DG( Family Welfare), Govt. of UP; the then MD of PACCFED; the then Assistant Engineer, PACCFED; the then Engineer, PACCFED; the then Chief Engineer, PACCFED, Lucknow and three Directors of Moradabad-based private firm and a Director of Gajraula(UP)-based private firm.

 

            It was alleged that Directors of Moradabad-based three private firms and another Director of Gajraula(UP)-based private firm entered into criminal conspiracy with the then Principal Secretary, Health & Family Welfare, Govt. of UP; the then Director General, Family Welfare, Govt. of UP and officials of UP Processing & Construction Cooperative Federation Ltd.(PACCFED) and other unknown persons with the illegal object to obtain the contract related to up gradation of 89 districts level hospitals of Uttar Pradesh for Rs. 89 Crores on the basis of false & bogus documents and by taking undue favors from the public servants in lieu of monetary considerations. A loss to the extent of Rs. 25 lakh per hospital was caused to the Government.

 

            It was established during investigation that officials of PACCFED in connivance with private persons favoured the ineligible and sick beneficiary firm belonging to the accused and released payment of Rs. 16.93 crores to the beneficiary firm without any receipt of material or services on the basis of false & forged documents. Out of this, an amount of more than Rs. 13 crores(approx) was cornered by accused Director of Moradabad-based firm which was used to pay alleged bribes to public servants and also invested in various firms / companies.

 

            During the course of further investigation, the CBI has today arrested the then MD, the then Chief Engineer; the then Superintendent Engineer and Assistant Engineer, all of PACCFED in this case from Lucknow.

 

            Further investigation in the case continues against the remaining accused.

 

            The public is reminded that the above findings are based on the investigation done by CBI and evidence collected by it. Under the Indian Law, the accused are presumed to be innocent till their guilt is finally established after a fair trial.
