THREE YEARS IMPRISONMENT WITH FINE OF Rs.56,000/- TO THE THEN OFFICIAL IN THE ARMY AND TWO PRIVATE PERSONS FOR MISUSING OFFICIAL PASSPORTS

            The  Special Judge for CBI Cases, Saket Court, New Delhi has convicted the accused M Suresh Babu, the then Lance Nayak based in Delhi and two Private persons David A Johnson & Nagarajan @ Raja U/s 419, 420, 465, 467, 468 & 471 IPC, U/s 12 Passport Act & 13(2) r/w 13(1)(d) of PC Act and sentenced them to undergo three years imprisonment with fine of Rs 56,000/-. The court had also convicted four other accused persons with the imprisonment of the period already undergone by them and fine of Rs 21,000/-. One accused has been acquitted by the court.

 

            A Case was registered on 28.11.2007 against Lance Nayak M Suresh Babu & others, U/s 120B, 419, 420, 467, 468 & 471 IPC and Sec 13(2) r/w 13(1)(d) of PC Act 1988 on the basis of the complaint received from Ministry of Defence. It was alleged in the complaint that some Army officials in conspiracy with private persons were misusing the official passports of army and diverting the same to private persons in order to facilitate their illegal migration to foreign countries.

 

             On completion of investigation, CBI filed chargesheet against accused M Suresh Babu & seven other private persons under various offences relating to Indian Penal Code, Passport Act and Prevention of Corruption Act.

 

            The trial Court found the accused guilty and convicted them.
