THREE YEARS RIGOROUS IMPRISONMENT TO THEN INSPECTOR OF TAMIL NADU POLICE AND THREE OTHERS IN A CASE RELATING TO FALSE INSURANCE CLAIM

            The Special Judge for CBI Cases, Madurai has convicted Shri K Kandasamy, the then Inspector of Police of K.Parmathi Police Station, Karur (Tamil Nadu) & three others in a false insurance claim case and sentenced them to undergo three years Rigorous Imprisonment with total fine of Rs.13,000/-.

 

            A case was registered on the directions of High Court against Shri K Kandasamy, then Inspector of Police, K.Paramathi Police Station, Karur; an Advocate; Shri A.Thiagarajan, a lorry owner; Shri B.Thirumoorthy @ Moorthy, Clerk of Advocate and Shri N.Sukumaran, a lorry driver on the allegations that the accused persons entered into criminal conspiracy during the year 1999 to cheat Oriental Insurance Company in a false insurance claim. On 26.091999, three persons died in an accident on Karuru- Coimbatore Road, when the motor cycle in which they travelled was dashed by a lorry coming in the opposite side. A case was registered with K. Paramathi Police Station. Shri. K. Kandasamy, the then Inspector of Police who investigated the case, conspired with other accused persons and in pursuance of the said criminal conspiracy, an Advocate arranged for a lorry owned by Shri. Thiagarajan to be substituted in place of the lorry that caused accident , which was not traced. Further to the conspiracy, Shri. N. Sukumaran had agreed to admit the gulit for having caused the accident. Accordingly, Shri. Kandasamy, then Police Inspector created false statements of witnesses and falsely implicating the susbsituted lorry in the accident. He had filed charge sheet before Judicial Magistrate -II, Karur. After the disposal of the case, the Advocate filed MCOP petitions in Dharapuram MACT Court on behalf of the relatives of the deceased persons , and a total compensation of Rs.10.81 lakh were awarded for the three petitions to be paid by Oriental Insurance Company.

 

            After the investigation of the case, CBI filed chargesheet against the accused persons U/s 120-B, 468, 420 r/w 511 IPC and section 13(2) r/w 13(1)(d) of PC Act, 1988.

 

            On completion of the trial, the Special Judge for CBI Cases, Madurai pronounced judgement convicting Shri K Kandasamy; Shri A.Thiagarajan; Shri B.Thirumoorthy @ Moorthy & Shri N.Sukumaran and acquitted the Advocate.
