FIVE TO TEN YEARS RIGOROUS IMPRISONMENT TO SEVEN ACCUSED PERSONS FOR FRAUDULENT ENCASHMENT OF NSCs AND KVPs TO THE TUNE OF RS.1, 17, 83,000/-(APPROX)

            The Special Judge for CBI Cases, Ghaziabad (UP) has convicted seven accused persons namely Maya Ram Bhat; Jamuna Prasad; Anupam Sharma; Lalit Kumar; Vinod Kumar; Rajendra Prasad and Shyam Das U/s 120-B of IPC r/w Section 419, 420, 409, 467, 468, 471, 411 of IPC and Section 13 (2) r/w section 13(1)(d) of PC Act, 1988 in a case relating to fraudulent encashment of NSC & KPVs amounting to Rs.1,17,83,000/-(approx) from Sub Post Offices at NOIDA (Uttar Pradesh). Accused Anupam Shrma; Lalit Kumar; Vinod Kumar & Rajender Prashad Sharma were sentenced to undergo ten years Rigorous Imprisonment with fine of Rs.27 lakh each. Shri Shyam Das was sentenced to undergo five years Rigorous Imprisonment with fine of Rs.9.5 lakh and Shri Maya Ram Bhatt & Jamuna Prasad (both postal employees), were sentenced to undergo seven years Rigorous Imprisonment with fine of Rs.33 lakh each.

 

            The case was registered by CBI on 06.11.2001 under section 120-B of IPC r/w Section 419, 420, 409, 467, 471, 411of IPC and Section 13 (2) r/w section 13(1)(d) of PC Act, 1988 on the request of UP Govt and subsequent Notification from Govt of India on the allegations of fraudulent encashment of 203 Nos. of NSCs and 451 Nos.of KVPs amounting to Rs. 1,17,83,000/-(approx) from Sector 12 and 55 Sub-Post Offices, NODIA (UP). During investigation, it was revealed that blank KVPs and NSCs were dispatched from India Security Press, Nasik in the year 1998-1999, out of which some NSCs/KVPs were lost/stolen during transportation. The private accused persons got hold of these blank NSCs/KVPs and forged the NSCs/KVPs in assumed names issued in back date from Arya Nagar, Alwar(Rajasthan); Bareilly Cantt(UP) and some other Post Offices. After forging the NCSs/KVPs, accused persons prepared forged NC-32 application forms giving bogus residential addresses for transfer of the said certificates from the issuing post office to the encashing post offices. It was further revealed that accused Mayaram Bhatt, then Sub-Post Master posted at Sector 12 Sub-Post office, Noida and Jamuna Prasad, then Postal Assistant, Post Office, Sector-55, Noida (UP) entered into a criminal conspiracy with other private accused persons and in furtherance of criminal conspiracy paid 654 NSCs/KVPs amounting to Rs. 1,17,83,000/-(approx).

 

            After completion of investigation, charge sheet was filed on 30.12.2004 in the Court of Special Judge, CBI Cases, Ghaziabad (UP) against Maya Ram Bhat; Jamuna Prasad; Anupam Sharma; Lalit Kumar; Vinod Kumar; Niranjan Tiwari; Rajendra Prasad; Shyam Das and Daya Ram. Charges were framed on 17.07.2007 against all the accused except Niranjan Tiwari who was declared PO. Accused Daya Ram did not appear before the court at the time of judgment, hence his name was not included in the judgment and NBW was issued against his sureties.

 

            The Trial Court pronounced judgment against seven accused persons.
