CBI FILES SUPPLEMENTARY CHARGESHEET AGAINST THEN HOME MINISTER OF RAJASTHAN AND THREE OTHERS IN THE SOHRABUDDIN SHEIKH ALLEGED FAKE ENCOUNTER CASE

            The Central Bureau of Investigation has today filed a supplementary charge sheet against then Home Minister of Rajasthan; then SP, Prakashan (Andhra Pradesh); then SHO, Singraykonda District Prakashan(Andhra Pradesh) and an Executive Director of a private marble company of Udaipur (Rajasthan) U/s 120-B r/w 364, 365, 368, 341, 342, 302 & 201 of IPC before the ACMM, 3rd Court, Mumbai in the alleged fake encounter of Shri Sohrabuddin and killing his wife, Smt.Kausarbi.

 

            The investigation of Sohrabuddin encounter case was initially conducted by ATS, Gujarat Police. Subsequently, as per orders of Hon'ble Supreme Court, an enquiry was conducted by CID Crime, Gujarat, outcome of which indicated that the concerned police officers, in furtherance of a criminal conspiracy, had, in the month of November 2005, abducted Sohrabuddin Sheikh & his wife Smt. Kausarbi from Andhra Pradesh, along with one more person. They illegally confined Sohrabuddin & Kausarbi at two Farm Houses intermittently at Ahmedabad. Sohrabuddin was killed in a fake encounter on 26-11-2005 and Kausarbi's whereabouts were not certain.

 

            Meanwhile the Hon'ble Supreme Court of India vide its order dated 12-01-2010 passed in Writ Petition (Crl.) No. 6 of 2007 filed by brother of Sohrabuddin ordered CBI to investigate the matter and submit report.

 

            CBI registered a case on 1st February 2010, U/s 120-B r/w 365, 368, 302, 201 IPC and took up the investigation. On completion of investigation, CBI filed charge sheet against 15 accused persons during 2010 in the Court of Addl. Chief Judicial Magistrate, Ahmedabad. The CBI has made a prayer to the Court to keep investigation open for further investigation under section 173 (8) Cr.P.C for probing further into the larger conspiracy. In furtherance of the investigation, CBI filed a supplementary charge sheet in October, 2010.

 

            Subsequently, Hon'ble Supreme Court of India transferred trial of the case to Mumbai Court, vide orders dated 27.09.2012 in Transfer Petition (Cri.) No. 44 of 2011. While passing the orders, Hon'ble Supreme Court also directed CBI to file supplementary Chargesheet at transferee court at Mumbai.

 

            Accordingly, supplementary charge sheet was filed before ACMM, 3rd Court, Mumbai on 14.05.2013. The Court has issued summons to the accused returnable on 4th June, 2013.

 

            The chargesheet submitted by the CBI is a conclusion of the findings of the CBI. However, the public is reminded that under the Indian law all accused are presumed to be innocent till proven guilty in the court of law.
