ONE TO THREE YEARS RIGOROUS IMPRISONMENT TO EIGHT ACCUSED INCLUDING THEN REGISTRAR OF CO-OPERATIVE SOCIETIES, DELHI FOR COMMITTING IRREGULARITIES RELATING TO A GROUP HOUSING SOCIETY CASE

            The Special Judge, Rohini Courts, Delhi has sentenced Shri Narayan Diwakar, the then Registrar of Cooperative Societies, Delhi to undergo one year & nine months Rigorous Imprisonment; Shri Yogi Raj, the then Assistant Registrar to undergo one year Rigorous Imprisonment; ShriNiranjan Singh, the then Dealing Assistant to undergo one year Rigorous Imprisonment; Shri Faiz Mohammed- the then Inspector Grade/II to undergo one year Rigorous Imprisonment and four private persons i.e Shri Srichand; Shri Anna Wankhede; Shri Mohan Lal & Shri Sushil Kumar Sharma, all to undergo three years & three months Rigorous Imprisonment for committing irregularities relating to a Group Housing Society case.

 

            CBI had registered a case on 03.01.2006 u/s 120-B r/w 420, 468, 471 of IPC & Section 8, 9 & 13(2) r/w 13(1)(d) of PC Act, 1988 against Shri Narayan Diwakar, IAS(1986) the then Registrar of Cooperative Societies (RCS), Delhi and others. The said case was registered in pursuance of the order of the Hon'ble High Court of Delhi in Civil Writ Petition No.10066/2004, directing the CBI to conduct investigation in the matter relating to 135 cooperative Group Housing Societies. It was alleged that during the year 2002-03, Sh.Narayan Diwakar- the then Registrar of Cooperative Societies, Delhi; Sh.Yogi Raj-the then Assistant Registrar; Sh.Niranjan Singh- the then dealing assistant; Sh. Faiz Mohammed- the then Inspector Grade/II- all in the office of RCS Delhi entered into criminal conspiracy with Sh.Srichand, a private person and other unknown persons for reviving a defunct society, namely SIEMENS Co-operative Group Housing Society. In pursuance to the conspiracy, the private accused had submitted forged & false documents and officials of RCS, NCT of Delhi had recommended for allotment of land to the DDA on the basis of the said documents and thereby gave undue pecuniary advantage/favour to the private persons.

 

            After thorough investigation, a charge sheet was filed on 30.11.2006 against Sh.Narayan Diwakar- the then Registrar of Cooperative Societies, Delhi; Sh.Yogi Raj-the then Assistant Registrar; Sh.Niranjan Singh, the then Dealing Assistant; Sh. Faiz Mohammed, the then Inspector Grade/II, all in the office of RCS Delhi and S/Sh. Srichand, Anna Wankhede, Mohan Lal, Sushil Kumar Sharma & two private persons u/s 120-B r/w 419, 420, 468, 471 IPC and Section 13(2) r/w 13(1)(d) of the Prevention of Corruption Act, 1988 and for substantive offences under section 419, 420/511, 468, 471 of IPC & section 15 of the P.C. Act, 1988. During the course of trial CBI examined 52 witnesses. One private person expired during the trial.

 

            The Special Judge CBI, Rohini Courts, Delhi held the eight accused guilty and acquitted one private person.

 

            In another case, on 03.12.2013, the Special Judge for CBI Cases, Rohini, Delhi has sentenced the accused Parsuram Gupta to undergo seven years Rigorous Imprisonment with a fine of Rs.11 lakhs; Madan Mohan Khanna; Nemi Chand Bansal & Anand Mohan to undergo five years RI with a fine of Rs. 10 lakhs each and A.K.Shankran(an official of RCS) to undergo five years RI with a fine of Rs. 2 lakhs for committing irregularities relating to a Group Housing Society Case.

 

            The instant case was registered on 08-03-2007 by CBI under section 120-B r/w 420, 468, 471 of IPC 13(2) r/w 13(1) (d) against the accused Parshuram Gupta and others on the directions of Hon’ble High Court, Delhi. It was alleged in the FIR that the resignation letters and the documents of the society i.e. Satyam Co-Operative Group Housing Society were forged by the accused persons and land was got allotted to the society by them in connivance with RCS officials. There were several violations of DCS Act 1972 and DCS Rules 1973.

 

            After thorough investigation, CBI filed a charge sheet on 03-06-2008 against Parshuram Gupta, Madan Mohan Khanna, Nemi Chand Bansal, Anand Mohan and A.K.Shankran in the Designated Court, Delhi.

 

            The Trial Court found the accused persons guilty and convicted them.
