           The Additional Sessions Judge & Special Judge (SC & ST cases), Jabalpur (Madhya Pardesh) has convicted Shri Rajiv Kumar Tiwari @ Rajan @ Raju @ Babloo resident of Village Khijiraha, Allahabad (Uttar Pradesh); Shri Khachu Ahirwar & his wife Smt. Mamta Ahirwar, both resident of Village Jugiyai, Distt. Tikamgarh (Madhya Pradesh) and sentenced Shri Rajiv Kumar Tiwari to undergo Life Imprisonment; Shri Khachu Ahirwar & his wife Smt. Mamta Ahirwar to undergo five years Rigorous Imprisonment.


            CBI had registered a case on 01.02.2007 on the orders dated 05.01.2007 of Madhya Pradesh High Court in Habeas Corpus writ petition no.1600/2005 and taken up the investigation of case FIR No. 277/06 dated 05.07.2006 U/s 368/34 of IPC of Police Station Barela, District Jabalpur (Madhya Pradesh). The instant case was related to alleged kidnapping of one girl, aged 20 years, resident of Village Silua, Police Station- Barela, District Jabalpur on 17.11.2005 at about 4.30 p.m. from her residence by Shri Rajiv Tiwari & two other private persons and taken to Allahabad on the intervening night of 17/18.11.2005. Since then her whereabouts were not known. The local police had filed chargesheet before the Court of Additional Sessions Judge (SC and ST cases), Jabalpur on 25.10.2006 against the said three persons U/s 366/368/34 of IPC and Section 3 (2) (5) of SC/ST (Prevention of Atrocities) Act, 1989. Aggrieved with the mode of investigation of Local Police, father of the girl filed Habeas Corpus Petition before Hon’ble High Court seeking CBI investigation.


           CBI had conducted exhaustive investigation to trace the missing girl at the place of occurrence at Village Silua and other places of Madhya Pradesh & Uttar Pradesh. Number of witnesses, such as family members / relatives of missing girl, teachers of her School, villagers of said Village etc were examined. During investigation, it was found that Shri Rajiv Kumar Tiwari was having affair with the girl. On 06.11.2005, he was publicly reprimanded by the father of girl for having affair with her. On false pretext, the girl was made to travel to Allahabad on 17.11.2005 by Shri Rajiv Kumar Tiwari with the help of two private persons (both resident of Village Silua, Distt. Jabalpur). Shri Rajiv Kumar Tiwari further informed the girl over telephone to go with the persons sent by him at Allahabad Station. Shri Khachu Ahirwar & his wife Mamta Ahirwar received the girl and allegedly sold her to one person at Tehsil Moth, District Jhansi (U.P) for Rs. 18,000/- on 24.11.2005 and forcible marriage of the girl with the said person was concluded. The girl was later traced. She contacted her family at Village Silua in May 2008 and informed that she was happy with her husband. The Hon’ble High Court allowed the girl to live with her husband.


           After conducting thorough investigation, CBI filed chargesheet against said persons on 29.12.2008 in the Court of Additional Sessions Judge (SC and ST cases), Jabalpur.


           The Trial Court found Sh Rajiv Kumar Tiwari, Sh. Khachu Ahiwar & his wife Smt. Mamta Ahiwar guilty and convicted them. The Court acquitted the two private persons both resident of Village Silua, Police Station Barela, District Jabalpur (M.P).
