CBI FILES TWO CHARGESHEETS AGAINST SEVEN ACCUSED INCLUDING THEN CHIEF ENGINEER, NOIDA AUTHORITY & OTHERS ON SEPARATE SUBJECTS

            The Central Bureau of Investigation has filed a charge sheet against six accused persons i.e. then CME(JAL)/Chief Engineer, NOIDA Authority; then Project Engineer, E&M-III; then APE, E&M-III'; then JE,E&M-III; Partner of a private Construction Company based at Delhi/Noida and said private Company U/s 120-B, 420, 468, 471of IPC and Section 13(2) r/w 13(1)(d) of PC Act, 1988 in the Court of Special Judge, CBI cases, Ghaziabad (Uttar Pradesh). The charge sheet was filed on the allegations relating to underground cable laying works worth Rs.2078.68 lakh(approx) & Rs.1732.34 lakh(approx), both allotted to said private construction company based at Delhi/Noida which was the part of the same NIT floated on 21.03.2011. During investigation, it was revealed that the work was allegedly pre-decided, the estimates were inflated, the BOQ(Bill of Quantity) was changed & there was a cartel formation among the contractors to make said private company as L-1 and the work started during April, 2011 onwards whereas the NIT was opened in August-September, 2011. These two works were related with underground cable laying in the area Sector 14A, Noida (Uttar Pradesh) to Mahamaya Flyover and from Fly over Film City to T Point Cambridge School, Noida. An alleged loss to the tune of Rs. 2,22,63,897/- (approx) and Rs. 6,62,50,802/-(approx) was caused to the Govt. Exchequer in both the works.

            In another matter, a supplementary charge sheet was also filed against a private person(wife of then Project Engineer, E&M-II), U/s 109 of IPC r/w Section 120-B, 420, 468, 471 of IPC and Section 13(2) r/w 13(1)(d) of PC Act, 1988 for her committing offences of abetting & criminal conspiracy. It was found that the private person(wife of then Project Engineer) was shown an employee of a private Construction Company based at Noida(UP). The said firm had earlier been charge sheeted. She was also allegedly provided an amount of Rs. 11 lakh(approx) as unsecured loan and she was also made a Director in one of Sister concerns of said private Construction Company which was alleegedly allotted an institutional plot worth Rs. 17.77 crore(approx.) by Greater NOIDA Authority. It may be noted that a gold brick of 1 kg worth Rs. 26 lakh(approx) was recovered during searches from her husband, an accused, who is still in judicial custody, as he was named in the chargesheet already filed against him on 15.03.2016.

            It may be noted that CBI registered a case on 30.07.2015 against then Chief Engineer, NOIDA/Greater NOIDA & Yamuna Expressway Authorities(Uttar Pradesh) and other unknown persons U/s 120-B, r/w 409, 420, 466, 467, 469, 471 of IPC and Section 13 (2) r/w 13 (1)(d) of PC Act 1988 for alleged corrupt practices in the laying of underground cable worth Rs. 9202 lakh(approx) and other allegations, in pursuance of the orders dated 16.07.2015 of Hon’ble High Court of Judicature at Allahabad, Lucknow Bench, Lucknow.

            After investigation, a chargesheet was filed on 15.03.2016 against 14 accused ie. then Chief Engineer; his wife(private person); then Project Engineer(E&M-II); two then Assistant Project Engineers(E&M-II); two then Junior Engineers(E&M-II); another then JE; then Managing Partner of Noida (UP) based private company; then Partner of Nehru Nagar, Ghaziabad based private company; then Managing Director of Raj Nagar, Ghaziabad based private company and the three said companies based at Noida, Nehru Nagar & Raj Nagar (both in Ghaziabad), Uttar Pradesh through their authorised representatives U/s 120-B r/w 420, 109, 468, 471 of IPC and Section 13(1)(d) r/w 13(2) of PC act, 1988 in the Court of Special Judge for CBI Cases, Ghaziabad (Uttar Pradesh) in connection with allegations relating to laying of underground cables at Udyog Marg and MP1 Marg at Noida(UP).  The investigation has revealed that the allotment of the work was allegedly pre-decided; tender formalities were wilfully violated; the estimate was highly inflated to caused undue gain to the contractor. An alleged loss of Rs.19.00 crore(approx) was caused to the Govt exchequer.

            The CBI had earlier conducted searches during August, 2015 at various places including Agra, Ferozabad, Noida & Greater Noida(UP) which led to recovery of documents of 38 immovable properties/houses at Noida and Agra and other incriminating documents. CBI had arrested then Chief Engineer of NOIDA/Greater NOIDA/Yamuna Expressway Authorities (Uttar Pradesh) on 03.02.2016 and the Project Engineer during December, 2015 in an on-going investigation of said case.

            Further investigation on the remaining portion of the FIR related to allotment of other projects and instances of corruption in the execution of other works having involvement of other accused is continuing.

            The public is reminded that the above findings are based on the investigation done by CBI and evidence collected by it. Under the Indian Law, the accused are presumed to be innocent till their guilt is finally established after a fair trial.
