CBI FILES A CHARGE SHEET AGAINST NINE ACCUSED INCLUDING THEN PRINCIPAL SECRETARY, UTTAR PRADESH GOVERNMENT; THEN MANAGING DIRECTOR OF UP ELECTRONICS CORPORATION; THEN DIRECTOR GENERAL(FW) OF UP GOVERNMENT & OTHERS IN A CASE RELATING TO NRHM

            The Central Bureau of Investigation has today filed a charge sheet in the court of Special Judge, CBI cases Ghaziabad (Uttar Pradesh) against 9 accused persons including the then Managing Director, UP Electronics Corporation, Lucknow; then Director of Lucknow based private Consultancy Services Firm; said private Consultancy Services firm of Lucknow through its Director; then Principal Secretary(Health) of UP Government; then Manager, Hardware, UP Electronics Corporation(UPLC); then GM, MIS,NRHM; then DG,FW, Lucknow; then Director, Medical Care, Lucknow who was ex-officio member of the monitoring committee and then GM (NP), NRHM, Lucknow U/s 120-B, 420, 471 of IPC and section 13(2) r/w 13(1)(d) of PC Act, 1988 on the allegations of causing huge loss to Government Exchequer.

            CBI had registered the case relating to NRHM on 11.06.2014 U/s 120-B of IPC r/w under Section 420, 471 of IPC and U/s 13(2) r/w 13(1)(d) of PC Act, 1988 against then Managing Director, UP. Electronics Corporation, Lucknow and others on the allegations of corrupt practices in the implementation of the Hospital Management Information System (HMIS). It was one of the NRHM cases which was registered after converting preliminary enquiry. The said PE was registered in pursuance of the orders dated 15.11.2011 of Hon’ble Allahabad High Court, passed in various petitions, on the alleged corrupt practices by the officials of Uttar Pradesh Electronics Corporation Ltd(a Govt. of UP Undertaking) in the computerization project in Government hospitals under Hospital Management Information System (HMIS), which was got executed through a private Consultancy Services Firm based at Lucknow (not empanelled with the PSU, during the period 2009-10 in the implementation of the project in 15 District level hospitals of UP), at exorbitant rates and also without following the tender proceedings, thereby causing alleged loss of Rs.2.4 crore(approx) to the Government Exchequer.

            It was further alleged that the supplier firm of Lucknow dealing in software only, had purchased the hardware from another firm which was an empanelled firm of UPLC @ Rs. 42,986/-(approx) per computer whereas the same was supplied to UPLC for Rs.57,143/-(approx) per computer which showed a difference/ loss of Rs. 98,93,835/-(approx).

            During investigation, it was revealed that the Director of a private Consultancy Services firm of Lucknow did not implement the said Hospital Management Information Services Project properly in the said 15 Districts level hospitals of UP. The rates of hardware items as well as of the software were allegedly claimed quite exorbitantly. The technical survey of HIS Project conducted in all 15 District Level Hospitals with the help of the experts of the DGS&D has revealed the alleged difference of rates of items so supplied by the vendor vis-à-vis the rates of DGS&D. The difference of rates in case of hardware and system software allegedly came to Rs.1,34,34,150/-(approx), whereas the difference in the rates of main HIS Application Software came to Rs. 63,40,890/-(approx). An alleged loss of 1,97,75,040/-(approx) was caused to Government exchequer.

            After thorough investigation, a chargesheet was filed.

            The public is reminded that the above findings are based on the investigation done by CBI and evidence collected by it. Under the Indian Law, the accused are presumed to be innocent till their guilt is finally established after a fair trial.
