FIVE YEARS RIGOROUS IMPRISONMENT TO THEN OFFICIAL OF REGISTRAR OF CO-OPERATIVE SOCIETIES DELHI AND FOUR PRIVATE PERSONS

The Special Judge, CBI Cases, Rohini, Delhi has convicted five accused persons i.e. Ashok Kumar Chauhan (Private Person), Piyush Kumar Sharma (Private Person), Akshay Kumar Jain (Private Person), Karamveer Singh (Then Dealing Assistant, working in the office of Registrar of Co-operative Societies, Delhi) and Vijay Singh Lunia (Private Person) u/s 120-B r/w 420, 468, 471 of IPC & Section 13(2) & 13(1)(d) of Prevention of Corruption Act, 1988 and sentenced them to undergo five years Rigorous Imprisonment with huge fines under relevant sections.

CBI had registered a Case relating to fraudulent revival of large number of Co-operative Group Housing Societies. Earlier a preliminary enquiry was conducted by CBI on the orders of the Hon’ble High Court of Delhi. During the course of Preliminary Enquiry, it was found that the Bhagwati Co-operative Group Housing Societies (CGHS) Ltd. was wound up vide order dt. 25.4.1990 by the Registrar of Co-operative Societies, Delhi as it was not found to be working in accordance with the rules, regulations & interest of the public in general. The said Society did not respond to the various communications from the Registrar of Co-operative Societies (RCS) for submission of the required documents, list of members etc. However, vide order dated 12.06.1997, the said Society was revived by the RCS. On the basis of such revival and approval of the freeze list of the members, the Bhagwati CGHS obtained land measuring 17,000 sq. mtrs in Sector-22, Dwarka allotted by the DDA at the fixed rate for such societies.

After investigation, a charge sheet was filed against 10 accused persons on 30.12.2008. The Trial Court held five accused guilty and acquitted/discharged three persons. Two persons expired during trial.
